Kelvio Terms of Service

1. About Kelvio

Kelvio is a digital property technology platform operated by Redline Plan Consultants (“Redline”, “Kelvio”, “we”, “us” or “our”).

Kelvio provides digital tools and services including floor-plan creation, property capture, image enhancement, AI visualisation, virtual renovation, virtual staging, terrain visualisation, property clean-up, 3D visualisation, video generation and related property content.

By creating an account, purchasing a service, subscribing to Kelvio or using Kelvio software, the user agrees to these Terms of Service.

2. User Accounts

Users must provide accurate information and are responsible for maintaining the security of their accounts and login credentials.

Users must not attempt to circumvent platform security, payment requirements, usage restrictions or access controls.

3. User Uploads

Users may upload photographs, videos, sketches, floor plans, architectural drawings, 360 imagery, drone imagery, site information, logos and other material (“User Content”).

Users retain their rights in their original User Content.

By uploading User Content, the user confirms they have the necessary rights, permissions or authority to provide that material to Kelvio.

The user grants Kelvio a limited licence to host, process, reproduce, transform and transmit the User Content only as reasonably necessary to provide the requested Kelvio service and operate the platform.

4. Artificial Intelligence

Some Kelvio functions use artificial intelligence, computer vision, automated image processing and third-party technology providers.

AI-generated outputs may contain errors, omissions, assumptions, distortions or generated elements.

Kelvio does not guarantee that AI-generated content accurately represents existing physical property conditions.

Users are responsible for reviewing generated outputs before relying upon, distributing or publishing them.

5. Floor Plans, Dimensions and Measurements

Unless expressly stated otherwise, automatically or AI-generated floor plans, measurements, dimensions and calculated areas are indicative only.

They must not be treated as certified surveys, construction documentation or verified measurements without appropriate independent verification.

6. Terrain Marking

Kelvio Terrain Marking provides visual representations of selected land areas.

Terrain boundaries or outlines generated or drawn within Kelvio are indicative visual representations only.

They are not cadastral surveys, title boundaries or licensed survey information unless independently verified by an appropriately qualified professional.

7. Land with Options

Land with Options creates conceptual visualisations showing possible uses of land or property.

Generated buildings, landscaping, parking areas, subdivisions and development concepts are illustrative only. They do not constitute:

• Planning approval
• Building approval
• Architectural advice
• Engineering advice
• Surveying advice
• Confirmation that development is permissible or feasible

All concepts remain subject to planning requirements, site conditions, title restrictions, engineering, building regulations and relevant authority approvals.

8. Virtual Renovation and AI Room Styling

These tools generate conceptual representations of how a property could potentially appear.

Generated images may change furniture, finishes, fixtures, landscaping, colours, materials and other visual elements.

Generated visualisations must not be represented as the property’s existing physical condition where doing so would be misleading.

9. Image Enhancement, Upscaling and Property Clean-Up

Image Enhancement, Upscaling, Object Removal and Property Clean-Up may materially modify photographs.

AI processing may reconstruct or generate portions of an image.

Users are responsible for reviewing modified images and ensuring they are not used in a misleading or deceptive manner.

10. Generated Videos and Animations

AI-generated videos, motion effects and animations are visual representations.

Generated movement, architectural elements, landscaping, lighting and other details may not accurately represent actual property conditions.

11. Generated Content

Subject to these Terms and applicable third-party restrictions, users may use outputs generated for them for legitimate personal or commercial purposes.

Kelvio does not guarantee that every AI-generated output will be unique or that similar content will not be generated for other users.

12. Intellectual Property

Kelvio and its licensors retain ownership of the Kelvio platform, software, interface, branding, technology, templates and proprietary platform materials.

Use of Kelvio does not transfer ownership of the Kelvio software, technology or branding to users.

13. Privacy and People Appearing in Uploads

Users are responsible for ensuring they have appropriate authority to upload photographs, videos, 360 captures and other material containing identifiable people or private information where such authority is required.

Personal information will be handled in accordance with the Kelvio Privacy Policy.

14. Third-Party Technology

Kelvio may use third-party cloud infrastructure, artificial intelligence providers, payment processors, analytics services, storage providers and other technology services.

Information may be transmitted to these providers where reasonably necessary to provide requested functionality.

15. Payments and Subscriptions

Prices and applicable charges will be displayed before purchase.

Where a subscription automatically renews, its price and renewal frequency must be clearly displayed before purchase.

Users may cancel recurring subscriptions using the cancellation functionality provided by Kelvio. Cancellation prevents future renewals but does not automatically create an entitlement to a refund for services already supplied, subject to rights available under Australian Consumer Law.

16. Kelvio Credits

Kelvio may use a credit-based system for certain AI or generation services.

Where credits apply, the required credits should be displayed before the user confirms an operation.

Applicable rules concerning purchased credits, validity, expiry, refunds or transferability must be clearly displayed when credits are offered.

17. Turnaround Times

Where Redline/Kelvio offers manual or assisted production services with stated turnaround periods, timeframes begin once all required information, files and payment have been received unless otherwise stated.

Estimated turnaround times are estimates unless expressly described as guaranteed.

18. Acceptable Use

Users must not use Kelvio to:

• Violate applicable law
• Infringe intellectual-property rights
• Violate privacy rights
• Upload material without appropriate authority
• Impersonate another person or organisation
• Fraudulently represent property conditions
• Deliberately create misleading property advertising
• Circumvent security or payment controls
• Interfere with the operation of the platform
• Use Kelvio for fraudulent or unlawful activities

Kelvio may reasonably restrict or suspend accounts where necessary to protect users, the platform or comply with legal requirements.

19. Service Availability

Kelvio relies on internet connectivity, cloud infrastructure and third-party technology.

Kelvio aims to provide reliable services but does not guarantee uninterrupted availability.

Features may be modified, updated or replaced as the platform develops, subject to applicable law and commitments applying to paid services.

20. Professional Reliance

Unless expressly stated otherwise, Kelvio-generated outputs are not substitutes for professional surveying, architectural advice, engineering, building advice, planning advice, legal advice, fire-safety advice or regulatory certification.

Where accuracy, safety, construction or regulatory compliance is important, appropriate professional verification should be obtained.

21. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable Australian legislation.

22. Liability

To the maximum extent permitted by law, Kelvio’s liability will be limited where it is lawful and reasonable to do so.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.

23. Changes to Terms

Kelvio may update these Terms where reasonably necessary to reflect changes to functionality, legal requirements, technology or business practices.

Where appropriate, users should be notified of material changes affecting existing paid services.

24. Governing Law

These Terms are governed by the laws of Victoria, Australia, subject to any mandatory rights or protections available to users under applicable law.
